"But I have a license......"

Often I am told by potential contractor clients that they have a license. After further inquiry I find out they have a business license or some other license, but the critical license for a contractor in Utah is a Contractor's license issued by the State of Utah, Department of Commerce, Division of Occupational and Professional Licensing. The status of a contractor's license can be checked online at https://secure.utah.gov/llv/llv.

It is also important to note that the State of Utah does not honor a license unless it is in the name of the entity that is doing business. For example, a license in the name of Joe Smith does not help if the company is Joe Smith, Inc.

Why does it matter? Well, under Utah law and most other jurisdictions, if the business doing business is not properly licensed, not only can they be cited criminally and fined, but they are unable to pursue in court any claims they may have for amounts unpaid.
